AUCTION TERMS & CONDITIONS
AUCTION DATE & TIMES: Chavies (Perry County), Kentucky: Thursday, August 23, 11:00 a.m. on-site.
INSPECTION: John Dixon & Associates’ representatives will be at the property on Tuesday, July 31 from 10:00 a.m. to 3:00 p.m. and Wednesday, August 22 from 10:00 a.m. to 4:00 p.m. Inspect at other times by appointment (Joe Tarpley, 706.346.9524 or joe@johndixon.com). Your complete inspection and the inspection of the property by your professionals prior to the auction is encouraged. Those inspecting the property assume all risks associated with any inspection of the property. Signs, arrows and tract signs will show property to be sold.
TERMS FOR LIVE BIDDING: Pay 10% down of the purchase price at the auction. Balance will be paid in full at closing to be held within 30 days. A copy of the Contract of Sale may be reviewed prior to the auction by contacting the auctioneer.
TERMS FOR ONLINE BIDDING: A deposit of $100,000 in certified funds made payable to John Dixon & Associates or wire transfer to qualify. Registration must be completed by 5 p.m. EDT on Monday, August 20, 2012. The $100,000 deposit must be received by 4:00 p.m. EDT on Wednesday, August 22, 2012. Balance of 10% down must be sent within 24 hours. The successful online bidder will be notified immediately following the closing of the auction and emailed the sale contract. The executed contract shall be emailed to K.J. Otis (kj@johndixon.com) or faxed to 770.425.4413. Should you fail to execute the Auction Real Estate Sales Contract and submit the balance of the earnest money JDA shall retain the $100,000 and pursue any other remedies available by law. Deposits from unsuccessful online bidders will be returned to them within 24 hours following the end of the auction. If you have any questions, you may contact our controller, K.J. BUYER’S PREMIUM: A 10% buyer’s premium will be added to the high bid. Example: For each $10,000, a 10% buyer’s premium of $1,000 will be added to arrive at the total purchase price of $11,000.
CLOSINGS: Balance of the purchase price is due on or before Monday, September 24, 2012.
CLOSING ATTORNEYS: Closings will be conducted by Donna Koerber, VP/Manager of First American Title Insurance Company, Seattle Washington (206.615.3021). Deed preparation and all other closing costs will be paid by the purchaser. Taxes will be prorated as of date of closing. Title insurance will be available at purchaser’s expense.
AGENCY: John Dixon & Associates, auctioneer/ broker, is acting exclusively as agent for the seller.
SPECIAL NOTE: Property is selling “as-is, where-is” with all faults and is selling subject to easements, leases, restrictions, covenants, conditions, zoning and all other matters revealed by a current survey or an inspection of the property or contained in public records. The only representation and warranties made are those contained in the Contract of Sale. Seller reserves the right to add or delete property and/or cancel the sale. Properties will be conveyed by Warranty Deed. Information contained herein was obtained from sources deemed reliable. The property will sell “as-is, where-is” with no warranty, expressed or implied, as to improvements, soil condition, environmental and wetlands, or zoning.
